These Terms govern your use of my-garmin-express.com (the "Site"), an independently operated website ("we," "us," "our"). By using the Site, its guides, or its live chat, you accept these Terms. If you do not accept them, do not use the Site.
The Site publishes independent educational guides about consumer GPS software and devices. Its chat widget is an automated guide: it asks a few questions and points visitors to the relevant section of the published guides. Its responses are automated and pre-written; no human operator is on the other end. The Site is not operated by Garmin Ltd., is not official Garmin support, and has no authority to act for any manufacturer. We do not sell software, subscriptions, or support services. We never request payment, remote access to your computer, or your account credentials. Anyone doing so in our name is not us.
Everything on the Site — articles, walkthroughs, chat answers, illustrations — is general information, not professional advice and not manufacturer documentation. Product behavior, requirements, and interfaces change without notice. Before acting on any procedure, verify it against the manufacturer's current official documentation for your exact device and software version.
Some guides describe procedures that modify your device or computer: installing or removing firmware and software, editing files on device storage in mass storage mode, moving maps to memory cards, deleting cached data, and changing system settings. These procedures carry inherent risk. Performed incorrectly, on the wrong device, or at the wrong time, they can cause permanent malfunction ("bricking"), data loss, or a voided warranty. In particular, deleting or altering system files on a navigator's internal storage — for example, preloaded basemap or map image files such as gmapbmap.img — can render the device unable to start or navigate.
You alone decide whether to perform any procedure. By performing one, you accept these risks in full. Always create a complete backup of device storage before changing it, never disconnect a device mid-update, and stop if on-screen behavior does not match the guide.
THE SITE AND ALL CONTENT, INCLUDING CHAT RESPONSES, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, COMPLETENESS, CURRENCY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PROCEDURE WILL WORK ON YOUR DEVICE, THAT CONTENT IS ERROR-FREE, OR THAT THE SITE WILL BE UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE'S OPERATOR, OWNERS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF USE, DEVICE DAMAGE OR FAILURE (INCLUDING BRICKED, NON-BOOTING, OR NON-NAVIGATING DEVICES), VOIDED WARRANTIES, LOST PROFITS, OR COSTS OF SUBSTITUTE GOODS OR SERVICES, ARISING FROM OR RELATED TO YOUR USE OF, OR RELIANCE ON, THE SITE OR ITS CONTENT — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES DAMAGES RESULTING FROM MISREADING, MISAPPLYING, OR PARTIALLY FOLLOWING A GUIDE, INCLUDING THE DELETION OF SYSTEM FILES SUCH AS GMAPBMAP.IMG.
IF, NOTWITHSTANDING THE ABOVE, LIABILITY IS FOUND, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED FIFTY CANADIAN DOLLARS (CAD $50) OR THE AMOUNT YOU PAID US TO USE THE SITE, WHICHEVER IS GREATER. YOU PAID NOTHING; THE SITE IS FREE.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where such laws apply to you, the exclusions and limits above apply to the fullest extent those laws permit, and nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.
You agree to indemnify and hold harmless the Site's operator from claims, damages, and reasonable legal costs arising from your misuse of the Site, your violation of these Terms, or your violation of any third party's rights.
The Site's original text, illustrations, and code are our copyrighted work. You may quote brief excerpts with attribution and a link; you may not republish full articles. Garmin and related product names are trademarks of Garmin Ltd. or its subsidiaries, used on the Site only to identify the products the guides describe; see the Independent Disclaimer for the full acknowledgment. No trademark license is granted.
The chat widget exists only to route you to the relevant section of our published guides. Its responses are automated, pre-written, and generic; they are not individualized advice, not a diagnosis of your device, and not a conversation with a person. Section 2 through Section 5 apply to chat content exactly as they apply to the articles it links to. Do not use the widget to submit unlawful content, malware, other people's personal information, or credentials of any kind; we may block access for abuse. Chat transcripts are processed as described in the Privacy Policy.
The Site links to official manufacturer pages and other third-party resources. We do not control them and are not responsible for their content or availability. Download software only from the manufacturer's official website.
We may amend these Terms by posting the amended version on this page with a new date; continued use after posting is acceptance. We may modify or discontinue any part of the Site at any time.
These Terms are governed by the laws of the jurisdiction in which the Site's operator is established, without regard to conflict-of-law rules, and disputes fall to the courts of that jurisdiction — except where the consumer-protection law of your place of residence grants you non-waivable rights to another law or forum.
If any provision of these Terms is held unenforceable, the remainder stays in effect, and the provision is enforced to the maximum extent permitted. These Terms, the Privacy Policy, and the Independent Disclaimer are the entire agreement between you and us concerning the Site.
